Freedom – Visually Impaired Woman’s Detention Case Reaches Delhi High Court

Freedom – A petition filed before the Delhi High Court has brought attention to a case involving a visually impaired couple, where a man has sought the court’s intervention for the release of his partner, alleging that she is being held against her will by her family due to religious differences.

Court Issues Notice to Family and Authorities

The matter came up before a division bench comprising Justice Navin Chawla and Justice Ravinder Dudeja. After hearing the initial submissions, the court issued notices to multiple parties, including the parents of the 23-year-old woman at the center of the case. The court has sought responses to the allegations made in the petition, which has been filed as a habeas corpus plea.

Relationship at the Heart of the Dispute

According to the petitioner, Ram Kripal, he and the woman are both completely visually impaired and have been in a mutually agreed relationship. He stated that their bond is based on trust, understanding, and shared life goals. However, he claims that opposition from the woman’s family stems primarily from their interfaith background, as he identifies as Hindu while she comes from a Muslim family.

The petition highlights that the couple had made a conscious decision to spend their lives together. It emphasizes that the relationship is not only consensual but also grounded in emotional compatibility and mutual respect.

Allegations of Forced Confinement

In his plea, the petitioner has alleged that the woman was taken away by her family members from her hostel accommodation in Delhi during the night of March 16–17. He claims that this action was taken after the family became aware of their relationship.

Since that time, the woman has reportedly been kept isolated from outside contact. The petitioner has told the court that she has not been allowed to communicate freely, raising concerns about her safety and well-being.

Communication Raises Concerns

The petition further states that on March 21, the woman managed to reach out to the petitioner using a different phone number. During this conversation, she allegedly informed him that she was being held against her wishes and was not permitted to leave.

This development has intensified the petitioner’s concerns, prompting him to seek immediate legal relief. He has expressed apprehension that her situation could worsen if no timely action is taken.

Claims of Threats and Safety Risks

Ram Kripal has also informed the court that he received warnings from the woman’s family, asking him to stay away from her. He described these warnings as threatening in nature and indicative of the family’s strong opposition.

In his plea, he has urged the court not only to ensure the woman’s release but also to provide protection for both of them. He has stated that he fears for her safety and believes there is a risk of physical harm or coercion, including the possibility of being forced into a marriage against her will.

Prior Complaint Yet to Yield Results

Before approaching the court, the petitioner said he had filed a complaint with the Women’s Commission in Ghaziabad. However, he claimed that no effective steps had been taken so far to address the situation or secure the woman’s freedom.

This lack of response, according to the petition, left him with no option but to seek judicial intervention. The case now places the responsibility on the court to examine the claims and ensure that the woman’s rights and safety are protected.

As the proceedings continue, the court’s response and the statements from the woman’s family will play a crucial role in determining the next course of action.
