Delhi High Court- Revokes Bail for Teacher in Child Assault Case
Delhi High Court-The Delhi High Court has ordered a fresh legal course in a child sexual assault case by cancelling the bail granted to a teacher accused of withholding crucial information from authorities.

The Delhi High Court has overturned the bail granted to a female teacher accused of concealing information related to the alleged sexual assault of a three-year-old girl by a staff member at a private school in Delhi’s Janakpuri area. The decision was delivered on Wednesday after the court found that the lower court had failed to properly assess important aspects of the case before granting her relief under the Protection of Children from Sexual Offences (POCSO) Act.
High Court Orders Teacher to Surrender
Justice Saurabh Banerjee allowed the appeal filed by the Delhi Police against the trial court’s order dated May 20, which had granted bail to the teacher. The High Court directed the accused to surrender before the concerned POCSO court within three days, no later than 12 noon. The court observed that matters involving alleged sexual offences against children require the highest degree of judicial caution while deciding bail applications.
Court Finds Trial Court Overlooked Key Evidence
While explaining the reasons for cancelling the bail, the High Court stated that the trial court had placed excessive reliance on the fact that the child did not mention the teacher during her initial statement. According to the court, such an approach was legally unsustainable, especially considering the age of the survivor.
Justice Banerjee observed that a three-year-old child cannot reasonably be expected to provide a complete and detailed account of every aspect of an incident immediately after the alleged offence. The court further noted that the survivor later identified the teacher in the presence of her mother and also pointed out the location where the alleged incident had taken place. These developments, the court said, were significant pieces of evidence that should not have been ignored while deciding the bail plea.
Incident Reported Following Mother’s Complaint
The case came to light on May 1 after the child’s mother approached the police with a complaint alleging that her daughter had been sexually assaulted by the school’s caretaker during school hours. Based on the complaint, the police initiated an investigation and registered the case under relevant legal provisions, including those under the POCSO Act.
Investigators have alleged that the teacher failed to report or disclose the alleged incident to the authorities, leading to legal proceedings against her. The allegations are currently under judicial examination, and the case remains pending before the competent court.
Earlier Bail of Main Accused Also Cancelled
This is the second major order passed by the Delhi High Court in connection with the same case. On June 29, the court had also cancelled the bail granted to the school’s caretaker, who is the principal accused in the alleged assault. That decision reinforced the court’s view that the seriousness of offences involving young children demands careful judicial scrutiny before granting bail.
The latest ruling further underscores the judiciary’s emphasis on protecting the interests of child survivors and ensuring that all individuals accused of playing a role in such cases are subjected to appropriate legal examination. The High Court’s observations also highlight the importance of considering the psychological and developmental limitations of very young children while evaluating their statements during criminal investigations.
