Judiciary – The Delhi High Court on Tuesday raised serious concerns over the safety arrangements provided to judicial officers in the national capital, observing that inadequate protection could undermine the independence of the judiciary.

Court Flags Risks Faced by Judicial Officers

During the hearing, the court pointed out that judges working at the district level handle a large number of cases daily and often deal with sensitive matters. This, the bench noted, naturally exposes them to potential threats. The judge remarked that the absence of proper security measures leaves these officers vulnerable, which is not acceptable in a system that relies on impartial and fearless decision-making.

The court emphasized that ensuring the safety of judicial officers is not merely an administrative issue but one that directly impacts the functioning of justice delivery.

Authorities Criticised for Delayed Response

Expressing dissatisfaction, the court questioned the approach adopted by the police and government agencies. It observed that waiting for an unfortunate incident before taking action would be irresponsible. The judge underlined that the risks associated with judicial work are already evident and should have been addressed proactively.

The response submitted by the authorities was described as lacking seriousness. The court noted that previous discussions on the matter had failed to produce meaningful outcomes and did not involve all the necessary stakeholders.

Demand for Round-the-Clock Security Gains Weight

The plea under consideration called for the appointment of Personal Security Officers and the implementation of comprehensive safety arrangements for district court judges. The court observed that the request for continuous security cover appeared reasonable given the nature of the responsibilities handled by these officers.

It further indicated that limiting security to only a select group of judges or certain categories may not be justified, as the risks are not confined to a few individuals but extend across the judicial system at the district level.

Fresh Meeting Ordered to Address Gaps

Taking note of the shortcomings in earlier discussions, the court declined to accept the record of a previous meeting and directed that a new meeting be convened within a week. The authorities have been asked to return with clear, practical, and effective proposals to address the issue.

The court made it clear that any future response must demonstrate seriousness and provide workable solutions rather than general assurances.

Reference to Measures in Other States

During the proceedings, it was highlighted that several states across the country have already implemented security arrangements for judicial officers. However, similar steps have not been effectively put in place in the capital, raising concerns about inconsistency in safeguarding members of the judiciary.

This comparison added weight to the argument that Delhi should not lag behind in ensuring adequate protection for its judicial officers.

Next Hearing Scheduled

The matter has been scheduled for further hearing on May 12. The court expects the concerned authorities to present concrete recommendations by then, reflecting a coordinated effort between various departments.
