Legal –  The Supreme Court has provided temporary relief to a contractor linked to the Janakpuri biker fatality, citing procedural delays in the ongoing legal process.

The apex court has granted interim bail to contractor Himanshu Gupta, who is among the accused in a case involving the death of a motorcyclist in Delhi’s Janakpuri area. The court observed that authorities had not yet submitted a formal response to his bail application, which influenced the decision to allow temporary release.

Court Notes Absence of Police Response

The bench, comprising two judges, pointed out that no counter affidavit had been filed by the police in response to Gupta’s plea. It also took into account that a co-accused in the matter had already been granted interim protection earlier. In light of these factors, the court decided to extend similar relief to Gupta until the next hearing.

The order specified that Gupta should be released in connection with the FIR registered at Janakpuri police station, provided he is not required in any other case. The court also directed him to fully cooperate with the ongoing investigation.

Background of the Incident

The case stems from an incident earlier this year in which a man named Kamal Dhyani lost his life after his motorcycle fell into an uncovered pit in the Janakpuri locality. The incident raised serious concerns regarding safety lapses and negligence in public infrastructure.

Following the incident, Delhi Police conducted an investigation and later filed a charge sheet in a local court. Authorities have accused multiple individuals, including contractors and subcontractors, of being responsible for the conditions that led to the fatal accident.

Charges and Legal Provisions

According to the charge sheet, the accused have been booked under several provisions related to criminal conspiracy and culpable homicide not amounting to murder. Additional charges include destruction of evidence and the alleged use of forged documents.

Three individuals have been named as accused in the case. Among them are Himanshu Gupta, Rajesh Kumar Prajapati, and another individual identified as Yogesh. Police have already taken two of the accused into custody as part of the investigation.

Earlier Bail Decisions and Developments

In a related development, one of the co-accused had previously received interim anticipatory bail earlier this year, and that relief has been extended until the next scheduled hearing. The court’s decision to grant interim bail to Gupta aligns with this earlier order, ensuring consistency in judicial treatment of the accused.

The case is now scheduled to be heard again on May 18, 2026, when further arguments and evidence are expected to be presented.

Trial Court Observations on Custody Claims

Separately, a trial court had recently dismissed the bail application of another accused, Rajesh Kumar Prajapati. He had alleged that he was unlawfully detained by police before his arrest. However, the court rejected this claim after examining available evidence.

The trial court referred to CCTV footage, call data records, and official documentation, which collectively indicated that the arrest was carried out in accordance with standard procedures. The judge noted that there was no credible evidence to support the allegation of illegal detention.

Evidence and Investigation Status

Authorities have submitted call data records along with the charge sheet, which played a key role in countering claims made by the accused. The court also remarked that considerable time had been spent reviewing these allegations, but they were not substantiated by any reliable material.

Investigators continue to examine the circumstances that led to the fatal accident, focusing on accountability for the uncovered pit and related safety failures.
