Court highlights deliberate involvement in the crime

While delivering the judgment, the court made it clear that the convict’s actions were intentional and calculated. According to the findings, the woman persuaded the survivor to accompany her under the false assurance of providing employment. She then took the girl to a secluded area in Najafgarh, where the crime occurred.

The court noted that the woman stayed present throughout the incident and played a critical role in enabling the offence. It was further established that she discouraged the victim from resisting and ensured that no one interfered during the act. Her conduct, the court said, reflected a clear breach of trust.

The court acknowledged that the survivor endured significant emotional, mental, and physical distress while seeking justice over more than a decade. It highlighted the importance of offering continued assistance to help victims rebuild their lives after such traumatic experiences.

Role of the minor co-accused examined

The court also addressed the role of the convict’s younger brother, who committed the act while being a minor at the time. Although he was considered a child in conflict with the law, the court clarified that the woman’s involvement was crucial in facilitating the crime.
