CourtCase – A Delhi court has withdrawn the non-bailable warrants issued against Students’ Federation of India (SFI) Joint Secretary Aishe Ghosh in connection with a 2021 criminal case, providing temporary relief as the matter moves forward.
A Delhi court on Thursday cancelled the non-bailable warrants (NBWs) that had been issued against Students’ Federation of India (SFI) Joint Secretary Aishe Ghosh in relation to a 2021 criminal case. The decision came after Ghosh personally appeared before the court, following an earlier stay on the warrants granted a day before. A detailed judicial order explaining the decision is still awaited.
Court Grants Relief After Personal Appearance
Judicial Magistrate Vijayshree Rathore revoked the warrants after Ghosh appeared before the court during the scheduled proceedings. The court had earlier suspended the execution of the warrants on Wednesday after her legal counsel informed the magistrate that she had failed to attend the previous hearing because of unavoidable circumstances. Taking note of the submission, the court allowed temporary relief before finally cancelling the warrants after her appearance.
Case Linked to 2021 FIR
The legal proceedings stem from a First Information Report (FIR) registered in 2021 at the Barakhamba Road police station in Delhi. The case was filed under the provisions of the erstwhile Indian Penal Code, including Section 188 for alleged disobedience of an order issued by a public servant, Section 447 related to criminal trespass, and Section 34 concerning acts committed with common intention.
The court has now scheduled the next hearing in the matter for November 21, when further proceedings are expected to take place.
CPM Raised Objections Over Police Visit
Before the court’s latest decision, the Communist Party of India (Marxist) had accused Delhi Police of attempting to arrest Aishe Ghosh by entering its headquarters, AKG Bhavan, in New Delhi. According to the party, police personnel arrived at the office in a private vehicle, and it claimed that one member of the team was not wearing an official police uniform.
The CPM further alleged that the officers entered the premises in connection with the pending case involving the student leader. However, the party stated that the police team left the location without making any arrest after Rajya Sabha Member of Parliament John Brittas questioned the officials regarding their presence and actions.
Delhi Police Action Defended
Responding to the criticism directed at the police, Bharatiya Janata Party President JP Nadda defended the conduct of the Delhi Police. He said the officers had acted in accordance with the established legal procedures and maintained that there had been no departure from the rules while carrying out their duties.
Nadda also remarked that student activists should be prepared to face legal processes whenever cases involving them are under investigation or before the courts. His comments came amid the political debate that followed the allegations made by the CPM over the police visit to its headquarters.
Proceedings to Continue
With the cancellation of the non-bailable warrants, the focus of the case now shifts to the upcoming hearing later this year. While the court has granted immediate relief to Ghosh by revoking the warrants, the criminal case itself remains pending. The detailed order from the court is expected to provide greater clarity on the reasons behind the decision, while the legal proceedings will continue according to the scheduled timeline.
