Bail – Supreme Court Declines Relief to Woman Accused in Narcotics Case
Bail – The Supreme Court on Friday refused to grant bail to a 60-year-old woman facing charges under the Narcotic Drugs and Psychotropic Substances (NDPS) Act. During the hearing, the court made strong observations regarding her alleged involvement in multiple similar cases, indicating that her repeated association with such offences weighed heavily against her request for relief.
Court Notes Repeated Allegations
The matter was heard by a bench comprising Justice Prashant Kumar Mishra and Justice Atul S. Chandurkar. While considering the plea, Justice Mishra remarked that the accused could no longer claim the benefit generally associated with being viewed as an ordinary woman accused because of her alleged repeated participation in narcotics-related offences. The court observed that such circumstances had affected her credibility in seeking leniency.
Challenge to High Court Decision
The woman had approached the apex court through a Special Leave Petition (SLP), challenging an order passed by the Madhya Pradesh High Court on March 26, 2026. The High Court had dismissed her fourth application for bail in connection with the same criminal case.
According to court records, the accused had already made several attempts to secure bail, but the requests were rejected at different stages of the legal process. The latest appeal before the Supreme Court was aimed at overturning the High Court’s decision and obtaining release during the pendency of the trial.
Defence Seeks Compassion Based on Age
Representing the petitioner, her counsel urged the court to take a compassionate view considering her age. The defence argued that the 60-year-old woman had been wrongly implicated in the case and maintained that she was innocent of the allegations levelled against her.
The lawyer submitted that the circumstances justified granting bail and requested the bench to consider the plea on humanitarian grounds. The defence also stressed that the accusations should be carefully examined before drawing conclusions regarding her role in the alleged offence.
Supreme Court Unconvinced by Arguments
Despite the submissions made on behalf of the accused, the Supreme Court was not persuaded to interfere with the earlier order. The bench declined to grant bail, signalling that the nature of the allegations and the history of similar accusations were significant factors in its assessment.
The court’s remarks reflected its concern over repeated involvement in offences related to narcotic substances, an area where Indian courts generally adopt a cautious approach due to the stringent provisions of the NDPS Act.
Case Continues Through Judicial Process
With the rejection of the bail plea, the accused will continue to face proceedings in accordance with the law. The decision also leaves intact the Madhya Pradesh High Court’s earlier order refusing her release.
The case remains subject to further judicial proceedings, and the allegations against the woman will ultimately be examined during the course of the trial. As of now, the Supreme Court’s refusal to grant bail marks the latest development in the ongoing narcotics-related case.
