Judiciary – Supreme Court Petition Seeks TVK Invitation to Form Tamil Nadu Government

Judiciary –  A fresh legal move has added another layer to the political developments unfolding in Tamil Nadu after the state election results produced no clear majority for any alliance. A petition has now been submitted before the Supreme Court seeking directions for the Governor to invite Tamilaga Vettri Kazhagam (TVK) chief C Joseph Vijay to form the government in the state.

The plea was filed on Friday by K Ezhilarasi, who identified herself as an advocate and an active member of TVK. In her submission before the apex court, she argued that the Governor should first invite the single largest political party to establish the government and later allow it to prove majority support during a floor test in the Legislative Assembly.

According to the petition, no alliance that contested the elections before polling managed to secure the required majority mark. Based on this situation, the petitioner maintained that TVK, being the largest individual party, should receive the first opportunity to stake claim for government formation.

Demand for Floor Test Procedure

The petition strongly emphasized the constitutional importance of conducting a floor test inside the Assembly rather than relying on external assurances of support. Ezhilarasi stated that letters of support, affidavits, or any private communication submitted to the Governor cannot replace a formal vote conducted on the Assembly floor.

The plea argued that the democratic process requires elected representatives to publicly demonstrate their support during legislative proceedings. It further claimed that such a process would ensure transparency and constitutional propriety during government formation in a politically uncertain environment.

Supreme Court Judgments Referenced

In support of her arguments, the petitioner referred to several earlier rulings delivered by the Supreme Court on matters connected to government formation and constitutional procedures. Among the judgments cited were the landmark SR Bommai v Union of India case and the Jagdambika Pal v Union of India ruling.

The petition stated that past judicial observations have consistently highlighted the importance of floor tests in determining majority support. It also claimed that the Governor’s constitutional role is limited to inviting a party to form the government rather than demanding complete proof of majority before extending such an invitation.

Political Attention on Tamil Nadu

The petition arrives at a time when political developments in Tamil Nadu continue to attract widespread attention following the election outcome. Discussions around coalition possibilities, independent support, and constitutional procedures have intensified in recent days as parties assess potential routes to power.

TVK leader C Joseph Vijay has emerged as a central figure in these discussions after the party’s electoral performance reportedly placed it in a significant political position. The latest legal intervention may further increase focus on the Governor’s next steps regarding the formation of the new government.

Matter Yet to Be Listed

Court records indicate that the petition has only recently been filed before the Supreme Court. As of now, the matter has not been scheduled for hearing, and no date has been officially announced for judicial consideration.

Legal experts believe the case could attract considerable attention because it involves constitutional questions linked to government formation, gubernatorial discretion, and legislative majority testing. However, the Supreme Court is yet to indicate whether it will take up the matter urgently.

Political observers are also closely monitoring future developments, especially regarding any decision taken by the Governor and the response from competing political parties in the state.
