Court Issues Notice to Family Members

The Delhi High Court has taken cognisance of the matter and issued notices to several parties, including the parents of the 23-year-old woman at the centre of the case. The bench, hearing the plea, has sought responses as it begins examining the allegations raised by the petitioner.

The case was filed by Ram Kripal, who informed the court that both he and his partner are completely visually impaired and have been in a mutually agreed relationship. He stated that their decision to be together has been met with strong resistance from the woman’s family, primarily due to religious differences.

Allegations of Forced Confinement

According to the petition, the woman was living in a hostel in Delhi before being allegedly taken away by her family. The incident is said to have occurred on the night of March 16–17, after her family became aware of the relationship.

The petitioner claims that since then, she has been cut off from all communication and kept under strict supervision. He has described the situation as a case of unlawful confinement, asserting that she is being held against her will.

Brief Contact Raises Alarm

In the days following her alleged confinement, the woman reportedly managed to reach out to the petitioner on March 21 using a different phone number. During this brief interaction, she is said to have informed him that she was being forcibly detained by her family members.

This communication, the petitioner argues, strengthens his concern that her liberty has been restricted without her consent. He further stated that her inability to maintain regular contact raises serious questions about her safety.

Fears Over Safety and Coercion

The petition expresses serious apprehension regarding the woman’s well-being. The petitioner has told the court that he fears she could be subjected to harm or pressured into a marriage she does not agree to.

He has also requested protection for both himself and his partner, citing alleged threats from her family. According to him, he has been warned to stay away from her, adding to his concerns about the situation escalating further.

Complaint Filed but No Action Yet

Before approaching the court, the petitioner had filed a complaint with the Women’s Commission in Ghaziabad. However, he claims that no effective steps have been taken so far to address the situation or ensure the woman’s release.

The lack of response from authorities prompted him to seek urgent judicial intervention through a habeas corpus petition, a legal remedy used to produce a person who is believed to be unlawfully detained.

Relationship Based on Mutual Consent

The petition emphasises that the relationship between the two individuals is consensual and built on mutual understanding. It states that both have chosen to spend their lives together and that their decision should be respected.

The case now places a spotlight on issues of personal liberty, interfaith relationships, and the rights of individuals with disabilities. The court’s proceedings are expected to focus on verifying the woman’s current situation and ensuring that her rights are protected under the law.

As the matter unfolds, the court’s response will be closely watched, particularly in relation to safeguarding individual freedom and addressing family interference in adult relationships.
