Politics –  The political contest over a Rajya Sabha seat in Jammu and Kashmir has resurfaced months after the October 2025 election, with the ruling National Conference (NC) accusing the opposition Peoples Democratic Party (PDP) of enabling an unexpected victory for the Bharatiya Janata Party (BJP). The dispute has drawn attention to alleged cross-voting and procedural gaps that may have influenced the final result.

Unexpected Result Despite Numerical Advantage

On October 24, 2025, voting took place for four vacant Rajya Sabha seats from Jammu and Kashmir. With the support of 59 legislators, the NC was widely expected to secure all four positions. However, the party managed to win only three seats, while the fourth went to BJP candidate Sat Sharma, whose party did not have sufficient numbers on its own.

This outcome surprised many observers and triggered questions within political circles. NC leaders pointed to discrepancies between expected and actual voting patterns, suggesting that some legislators may not have adhered to declared party positions.

Allegations of Cross Voting Emerge

NC spokesperson Imran Nabi Dar, who was also the party’s candidate for the fourth seat, publicly raised concerns about possible cross-voting. He questioned why certain PDP legislators, who had reportedly committed to backing NC candidates, might have voted in favor of the BJP.

According to the election results, Sat Sharma secured 32 votes—four more than the BJP’s legislative strength—while three ballots were invalidated. Imran Nabi Dar received 21 votes, falling short despite prior assurances of support from other parties and independent members.

The NC has suggested several possible motivations behind the alleged cross-voting, including political incentives, strategic alignments, and personal gains. However, no concrete evidence has been formally presented to substantiate these claims.

RTI Reply Raises Procedural Questions

The controversy gained momentum following a response obtained under the Right to Information (RTI) Act. The reply revealed that the PDP, despite having three MLAs at the time and extending support to NC candidates, did not appoint any authorized agents for the election process.

In contrast, seven authorized agents were नियुक्तed by three parties: four by the National Conference, two by the BJP, and one by the Congress. These agents are responsible for verifying votes cast by party legislators before ballots are deposited.

Under Rule 39AA of the Conduct of Election Rules, 1961, such verification is a key procedural safeguard intended to ensure transparency and party discipline during Rajya Sabha elections.

Absence of Agents Sparks Debate

The absence of authorized agents from the PDP has raised concerns about oversight during voting. Since the party had publicly backed NC candidates, its decision not to appoint agents has led to speculation about whether it was able to effectively monitor how its legislators voted.

Political analysts note that while the rules allow parties to appoint agents, failure to do so can limit their ability to verify compliance with party directives. This procedural gap has now become a central point in the ongoing debate.

Focus Turns to Unidentified Legislators

As discussions continue, attention has shifted to the identities of legislators who may have voted against party lines or cast invalid ballots. The exact number and names of such individuals remain undisclosed, adding to the uncertainty surrounding the election outcome.

Whether these details will be made public remains unclear. For now, the issue continues to fuel political exchanges between the NC and PDP, with broader implications for legislative transparency and party accountability in future elections.
