LegalCase – Judicial developments in the Kerala actress assault case remain a key focus as the Kerala High Court has admitted the state government’s appeal challenging the acquittal of several accused and seeking stricter punishment for those already convicted.

The 2017 actress assault case has once again moved into the spotlight after the Kerala High Court formally considered an appeal filed by the state government against the acquittal of actor Dileep and three other accused. The appeal also requests a review of the punishment awarded to the individuals convicted in the case, marking a significant new stage in one of Kerala’s most closely watched criminal proceedings.

High Court Begins Examination of Appeals

A Division Bench comprising Justice Raja Vijayaraghavan V. and Justice K.V. Jayakumar has taken up the matter for consideration. The appeal was originally filed during the tenure of the state government led by Chief Minister Pinarayi Vijayan and is now advancing through the appellate process.

According to the prosecution, actor Dileep, listed as the eighth accused, along with Charly Thomas, Sanilkumar alias Mesthiri Sanil, and Sarath G. Nair, played roles in an alleged conspiracy linked to the abduction and assault of the actress. The state has challenged their acquittal, arguing that the findings require further judicial examination.

Convicted Accused Also Seek Relief

At the same time, the High Court is hearing separate appeals filed by those who were convicted by the trial court. These accused have questioned both their convictions and the sentences imposed on them.

During Monday’s proceedings, the court recorded that senior advocate V. Ajakumar has been appointed as the Special Public Prosecutor representing the state. He had also appeared for the prosecution during the trial stage, giving him extensive familiarity with the case record and evidence presented earlier.

Court Orders Trial Records to Be Produced

The Bench directed that all records from the trial court be placed before the High Court for review. The matter has been scheduled for further consideration after two weeks, when petitions seeking suspension of sentences filed by the convicted individuals, including principal accused Sunil N.S., widely known as Pulsar Suni, are expected to be heard.

The production of trial records is considered an important procedural step as the appellate court examines the legal and factual findings reached during the original proceedings.

Background of the Trial Court Verdict

In December, the Principal District and Sessions Court in Ernakulam convicted six accused and imposed prison terms of 20 years. However, the court acquitted Dileep and certain others after concluding that the prosecution had not established the alleged conspiracy beyond reasonable doubt, a standard required in criminal cases.

The acquittal attracted widespread public attention because of the case’s prominence and the lengthy legal battle pursued by the survivor over several years.

Case That Drew Statewide Attention

The incident dates back to February 2017, when a prominent Malayalam film actress was allegedly abducted while travelling between Thrissur and Kochi. Investigators alleged that she was assaulted inside a moving vehicle, an incident that generated intense discussion across Kerala and prompted significant debate within the film industry and wider society.

With appeals now pending from both the state government and the convicted accused, the High Court’s proceedings are expected to revisit crucial aspects of the investigation, evidence, witness testimonies and legal arguments. The next phase of hearings is likely to be closely monitored as the judiciary reviews one of the state’s most high-profile criminal cases.
