Crime – Supreme Court Halts Execution of Convict in Bhopal Child Murder Case

Crime – The Supreme Court on Tuesday ordered a temporary suspension of the death penalty awarded to Atul Nihale, who had been convicted for the rape and killing of a five-year-old girl in Madhya Pradesh. The stay was issued while the court considers the accused’s appeal challenging the capital punishment.

Supreme Court Bench Grants Interim Relief

A three-judge bench comprising Justices Vikram Nath, Sandeep Mehta and N V Anjaria directed that the execution of the sentence be paused until further proceedings. The order came after the convict approached the Supreme Court seeking relief from the death sentence imposed by lower courts.

The bench did not enter into the merits of the case at this stage but decided to halt the execution to allow detailed examination of the appeal.

High Court Had Upheld Death Penalty Earlier

Earlier in January 2026, the Madhya Pradesh High Court had confirmed the death sentence awarded by a special Protection of Children from Sexual Offences (POCSO) court in Bhopal. The High Court had concluded that the nature of the offence, along with the lack of mitigating circumstances, justified the harshest punishment available under law.

The High Court bench, consisting of Justices Vivek Agarwal and Ramkumar Choubey, had dismissed Nihale’s appeal against the trial court verdict. The judges observed that the brutality of the crime placed it within the legal category often referred to as the “rarest of rare” cases, a standard used by courts in India to determine when capital punishment may be appropriate.

Following the High Court’s decision, the convict moved the Supreme Court seeking intervention.

Details of the Incident and Investigation

According to the prosecution, the case began when the young girl’s parents filed a missing person complaint on September 24, 2024. The child had reportedly left home but did not return, prompting the family to alert authorities.

Police launched an extensive search operation in the surrounding areas after the complaint was registered. Investigators eventually traced a suspicious odor coming from an apartment located in Bajpai Nagar in the Eidgah Hills area of Bhopal.

When officers forced entry into the flat, they discovered a white plastic water tank inside the bathroom. Inside the container, the decomposed remains of a child were found.

Identification of the Victim

The body recovered from the apartment was later identified by the victim’s parents as their missing daughter. Investigators subsequently linked the accused, Atul Nihale, to the crime.

During the trial, the prosecution presented evidence to establish the sequence of events and the involvement of the accused in the assault and murder. Based on the material presented in court, the special POCSO court in Bhopal convicted Nihale and imposed the death sentence.

Legal Process Continues in Supreme Court

With the Supreme Court now staying the execution, the legal proceedings are expected to continue as the court examines the arguments presented by both sides. The final outcome will depend on the court’s detailed review of the evidence, legal reasoning, and the principles governing capital punishment in India.

For now, the stay order ensures that the execution will not take place until the Supreme Court completes its hearing and issues a final judgment.
