Lokayukta – Ballari Man Convicted for Defaming Karnataka Upa Lokayukta Through Letters

Lokayukta –  A Bengaluru court has convicted a Ballari resident for making defamatory remarks against the Karnataka Upa Lokayukta, holding that the statements were intended to damage the reputation of both the official and the institution.

A Bengaluru sessions court has sentenced a resident of Ballari to six months of simple imprisonment and imposed a fine of Rs 5,000 after finding him guilty of making defamatory and insulting allegations against Karnataka Upa Lokayukta Justice KN Phaneendra. The court ruled that the accused deliberately attempted to tarnish the reputation of the senior judicial officer as well as the Lokayukta institution through written communications.

Court Finds Intent to Harm Institutional Reputation

The judgment was delivered by the 67th Additional City Civil and Sessions Court, where Judge Rashmi M observed that Justice KN Phaneendra, a former judge of the Karnataka High Court, has earned a reputation for integrity, honesty and dedicated public service. According to the court, the letters sent by the accused contained statements that were not only derogatory but were also intended to lower the dignity of the Upa Lokayukta and weaken public confidence in the Lokayukta system.

The court held that such conduct attracted the provisions of Section 17(2) of the Karnataka Lokayukta Act, 1984, which deals with offences involving defamatory remarks against the institution and its officials.

Letters Became Key Evidence in the Case

During the proceedings, the court closely examined two letters written by the accused in February 2023 along with his reply to a show-cause notice dated May 11, 2023. The judge concluded that the language used in these communications clearly reflected an intention to bring disrepute to the Upa Lokayukta and the Lokayukta office.

Based on this assessment, the court found sufficient grounds to convict the accused and impose both imprisonment and a monetary penalty.

Background of the Original Complaint

The dispute traces back to 2015 when the accused approached the Lokayukta with allegations against the Assistant Commissioner of the Department of Hindu Religious and Charitable Endowments in Ballari district. He claimed that several shops, including one belonging to his father, had been removed during an eviction drive conducted in 2012.

Following the complaint, the Lokayukta sought an explanation from the concerned authorities. In July 2017, the Assistant Commissioner submitted a report stating that the eviction was linked to plans for constructing a commercial complex aimed at increasing temple revenue. The report further stated that shops would be allotted in accordance with applicable rules.

It also explained that the proposal to construct new shops was later rejected by the City Municipal Council Commissioner because Chariot Street was scheduled to be widened from 15 metres to 18 metres.

Further Complaints Led to Fresh Correspondence

The matter did not end there. The complainant later alleged that officials had failed to remove encroachments along Chariot Street despite earlier assurances. Acting on these concerns, the authorities reportedly carried out the clearance of encroachments and submitted a compliance report before the Lokayukta.

However, instead of closing the matter, the accused allegedly sent additional letters containing objectionable remarks addressed to the Upa Lokayukta. Similar communications were also forwarded to the Lokayukta, repeating the same allegations and language that later became the subject of criminal proceedings.

Conviction Reinforces Protection of Public Institutions

In its ruling, the court underlined that criticism of public authorities must remain within the bounds of law and should not cross into defamatory or abusive conduct. The judgment reaffirmed that institutions such as the Lokayukta, which are entrusted with ensuring accountability in public administration, must be protected from deliberate attempts to undermine their credibility through baseless and defamatory statements.
