MSME – Government Introduces Bill to Strengthen Payment Security for Small Businesses

MSME – The Central Government has introduced a new amendment bill aimed at improving the business environment for micro, small and medium enterprises by ensuring quicker payments, strengthening legal safeguards and simplifying compliance procedures.

The Union Government on Tuesday introduced the Micro, Small and Medium Enterprises Development (Amendment) Bill, 2026 in the Rajya Sabha, proposing a series of changes designed to modernise the legal framework governing India’s MSME sector. The proposed legislation focuses on reducing payment delays, improving financial stability for smaller businesses and creating a more transparent regulatory environment that supports long-term growth.

Bill Introduced to Match Changing Business Environment

While presenting the Bill in the Upper House, Union Minister Jitan Ram Manjhi said the amendments have become necessary because the business landscape has changed considerably since the enactment of the MSME Development Act in 2006.

According to the minister, the existing law played a significant role in supporting the country’s micro, small and medium enterprises over the past two decades. However, rapid advancements in digital transactions, evolving industrial requirements and changing business practices have created the need for a more updated legal framework. He said the proposed amendments are intended to keep the legislation aligned with current economic realities.

Focus on Faster Payments and Stronger Legal Protection

One of the key objectives of the amendment is to ensure that MSMEs receive payments on time, a long-standing challenge for many small businesses across the country. The proposed law also seeks to introduce stricter consequences for violations related to delayed payments, making the enforcement mechanism more effective.

The government believes these measures will help reduce financial stress faced by smaller enterprises by improving cash flow and providing greater confidence in commercial transactions. Officials say stronger legal safeguards are expected to make business operations more secure while encouraging timely settlement of dues.

Measures to Improve Ease of Doing Business

The Bill has also been designed to promote ease of doing business by simplifying compliance requirements and encouraging a trust-based regulatory framework within the MSME ecosystem.

According to the proposed legislation, the amendments aim to update the provisions of the MSME Development Act, 2006 so that they reflect the changing needs of businesses. The government expects these reforms to create a more efficient environment for entrepreneurs while reducing unnecessary procedural hurdles.

Strengthening Dispute Resolution Mechanism

Another important feature of the Bill is the proposal to improve the mechanism for resolving disputes related to delayed payments. It seeks to strengthen the process for enforcing arbitral awards in cases involving micro and small enterprises, ensuring that legal decisions can be implemented more effectively.

The legislation also proposes to provide greater flexibility to state governments in deciding the composition of the Micro and Small Enterprises Facilitation Council (MSEFC). This change is expected to enable states to establish additional Facilitation Councils wherever required, helping resolve commercial disputes more efficiently and reducing case backlogs.

Government Seeks More Efficient MSME Ecosystem

If passed by Parliament, the amendment is expected to modernise the country’s MSME regulatory framework while addressing some of the most persistent challenges faced by small businesses. By focusing on timely payments, improved dispute resolution and simplified compliance, the government aims to build a more transparent and business-friendly ecosystem for millions of enterprises operating across India.
