Supreme Court Steps In Over Election Dispute

The direction was issued by a bench led by Chief Justice Surya Kant along with Justice Joymalya Bagchi while hearing a petition filed by advocate Birender Sangwan. The matter relates to concerns raised over the conduct of the Bar Council of Delhi elections, which were held earlier this year.

During the hearing, the apex court observed that the controversy surrounding the election process required a closer judicial examination, especially because original records, including ballot papers and related documents, may need to be reviewed during the proceedings.

Delhi High Court Asked to Form Special Bench

In a significant move, the Supreme Court transferred the matter to a division bench of the Delhi High Court. The bench also requested the Chief Justice of the Delhi High Court to constitute a special bench within the current week for urgent hearings.

The court stated that the dispute involved issues that could require examination of physical election material and records. Considering the complexity of the matter, the judges agreed that the Delhi High Court would be the appropriate forum for detailed adjudication.

The order further noted that counsels appearing for all sides had broadly agreed that a division bench should hear the petitions to ensure effective handling of the case.

Background of the Bar Council Elections

The Bar Council of Delhi elections took place in February under the supervision of retired Delhi High Court judge Justice Talwant Singh, who acted as the returning officer for the polls.

The election process, however, became controversial after allegations of violations of election rules and misconduct surfaced during the campaign period. On February 22, authorities placed 67 candidates under summary suspension over alleged large-scale breaches of the Model Code of Conduct and Election Rules, 2023.

Among those suspended were two senior advocates, adding further attention to the dispute within the legal community.

Allegations Trigger Judicial Intervention

The allegations related to tampering and procedural violations prompted multiple petitions before the courts. Concerns were raised regarding the fairness of the election process and whether established rules governing the polls had been properly followed.

The Supreme Court’s latest order effectively pauses the declaration of results until the Delhi High Court examines the petitions and hears all parties involved.

Legal observers believe the case could have a wider impact on how professional body elections are supervised and regulated in the future, especially when allegations of electoral misconduct emerge.
