Judiciary – Supreme Court Orders Fresh Hearing in Kuldeep Sengar Case

Judiciary –    The Supreme Court on Friday overturned a Delhi High Court decision that had temporarily suspended the life sentence awarded to former BJP legislator Kuldeep Singh Sengar in the 2017 Unnao rape case. The top court directed the High Court to re-examine Sengar’s request for suspension of sentence before the summer recess begins.

Supreme Court Cancels Relief Granted by High Court

A bench of the Supreme Court ruled that the earlier order granting relief to Sengar could not stand and instructed the Delhi High Court to hear the matter again. The apex court also asked the High Court to complete proceedings related to Sengar’s appeal against his conviction and life imprisonment within a period of two months.

The case has remained one of the most closely watched criminal matters linked to a political figure in recent years. Sengar was convicted in connection with the rape of a minor from Uttar Pradesh’s Unnao district and was later sentenced to life imprisonment.

Court Seeks Review of Legal Questions

During the hearing, the Supreme Court observed that certain legal aspects raised in the matter required fresh consideration. Among the issues highlighted was whether a sitting or former Member of the Legislative Assembly can be treated as a “public servant” under specific provisions of the Protection of Children from Sexual Offences (POCSO) Act.

The apex court asked the Delhi High Court to carefully reconsider these legal points while hearing the plea again. The direction is expected to shape the legal interpretation connected to prosecution under child protection laws in cases involving elected representatives.

No Opinion on Merits of the Case

While cancelling the High Court’s earlier order that had granted bail-related relief to Sengar, the Supreme Court clarified that it had not made any observation regarding the merits of the criminal case itself. The bench stated that its intervention was limited to procedural and legal concerns surrounding the suspension of sentence.

Legal experts note that such clarifications are important to ensure that future hearings remain unaffected by any preliminary observations made during appellate proceedings.

Background of the Unnao Case

The Unnao case drew nationwide attention after allegations surfaced in 2017 involving the rape of a minor girl. The matter later triggered widespread public debate over political accountability and protection for survivors of sexual violence.

Following an investigation, Sengar was convicted by a trial court and sentenced to life imprisonment. The case was subsequently transferred outside Uttar Pradesh amid concerns over fairness and security.

The latest direction from the Supreme Court means that the Delhi High Court will now revisit Sengar’s plea and continue hearing his appeal within the timeline fixed by the apex court.
