Investigation – NIA Claims Yasin Malik Used Pakistan Links for Kashmir Agenda

Investigation – The National Investigation Agency has informed the Delhi High Court that separatist figure Yasin Malik allegedly maintained connections with senior leadership in Pakistan to promote a separatist narrative in Jammu and Kashmir. According to the agency, these interactions included outreach to key political figures across Pakistan’s leadership structure.

NIA Details Alleged International Contacts

In its submission before the court, the NIA stated that Malik was in touch with high-ranking officials in Pakistan, including the country’s prime minister, president, members of the senate, and provincial leaders. The agency argued that these associations were not incidental but were used strategically to advance a campaign against India and support separatist objectives in the region.

The claims form part of the NIA’s appeal seeking the death penalty for Malik in a terror funding case. A trial court had earlier sentenced him to life imprisonment after he admitted to the charges.

Agency Rejects Political Engagement Argument

Malik had argued that his interactions with several Indian prime ministers and officials over the years should be considered in his favor, suggesting that he was engaged in dialogue processes concerning Kashmir. However, the NIA dismissed this line of defense, stating that such interactions were irrelevant to the charges of terror funding and did not mitigate the seriousness of the allegations.

The agency further asserted that references to meetings with Indian political leaders, foreign representatives, and members of the media were presented primarily to create a favorable public image and attract sympathy.

Links to Militant Figures Highlighted

In its affidavit, the NIA emphasized that Malik’s mention of high-level contacts does not override evidence of his alleged links with individuals associated with militant organizations. The agency specifically pointed to connections with figures such as Hafiz Saeed of Lashkar-e-Taiba and Syed Salahuddin of Hizbul Mujahideen.

According to the NIA, these associations reinforce the case that Malik played a role in activities linked to terrorism, regardless of any parallel engagement with political or diplomatic channels.

Court Hearing Deferred

The matter was scheduled for hearing before a bench comprising Justices Navin Chawla and Ravinder Dudeja. However, proceedings were postponed after Malik informed the court that he had not received the NIA’s response to his earlier submissions. The case is now expected to be taken up again in July.

Malik Presents His Own Defense

Malik, who is representing himself in court, has made several claims regarding his past interactions. He told the court that he had met Hafiz Saeed and other individuals in 2006 at the request of a senior Intelligence Bureau official. Additionally, he stated that Ajit Doval had visited him during his imprisonment in the early 2000s and informed him about his release.

The NIA has contested these assertions, arguing that such claims relate to personal communications that are not substantiated in the context of the current case. The agency maintained that these points appear to have been raised primarily to influence public perception rather than address the legal issues at hand.

Focus Remains on Terror Funding Charges

The central issue before the court continues to be the allegations of terror financing. The NIA has reiterated that the evidence presented supports its position and justifies a stricter punishment. The agency’s plea underscores its view that the case involves serious national security concerns that go beyond individual claims of political engagement.

As the proceedings continue, the court is expected to examine both the factual and legal aspects in detail before arriving at a final decision.
