Defamation – The Bombay High Court has directed the immediate removal of objectionable online content targeting Union Minister Nitin Gadkari, stating that the material contains abusive, obscene, and defamatory allegations that should not remain accessible to the public.

The Bombay High Court on Wednesday granted interim relief to Union Minister for Road Transport and Highways Nitin Gadkari by ordering major technology companies, including Meta, X Corp, and Google LLC, to promptly remove social media posts and other online material that allegedly defame him. Justice Arif Doctor observed that the content was offensive on its face and had no place on digital platforms where it could be viewed by people of all age groups, including young internet users.

Court Questions Platform Accountability

During the hearing, the court raised concerns about whether large technology companies have sufficient systems to automatically identify and remove clearly abusive or vulgar content. Justice Doctor remarked that with advanced technological capabilities already available, online platforms should be able to detect such material without requiring victims to seek judicial intervention every time defamatory posts appear.

The court emphasized that social media companies should strengthen their moderation systems to prevent the spread of harmful content and respond quickly whenever such material is reported.

Future Uploads Should Be Removed Without Delay

The bench also noted that if similar posts, including deepfake videos or AI-generated content, are uploaded in the future, Gadkari may directly approach the concerned digital platforms. The companies have been advised to act without unnecessary delay in removing such content once informed.

The matter has been scheduled for another hearing after four weeks. In the meantime, the respondents have been instructed to submit their replies before the court.

Civil Suit Filed Over Alleged Deepfakes

The interim order comes after Gadkari recently filed a civil suit against Meta, X Corp, Google LLC, and several unidentified individuals over allegedly fabricated online content related to the government’s ethanol-blended fuel policy. Represented by advocate Sandeep Ladda, the minister has sought the immediate removal of all disputed material, a permanent injunction against its circulation, and compensation of Rs 11 crore for the alleged damage caused to his reputation.

According to the legal petition, several AI-generated and manipulated posts falsely suggested that Gadkari personally controlled the ethanol-blending programme and claimed that he and members of his family had received financial benefits from the policy.

Minister Rejects Allegations

The petition argues that the claims circulating online are entirely false and were created with the intention of damaging Gadkari’s public image. It states that the misleading content has seriously affected his reputation and personal rights by presenting fabricated allegations as facts.

The minister also clarified before the court that the ethanol-blending programme, including the E20 fuel policy, is administered by the Ministry of Petroleum and Natural Gas. He asserted that the policy is not managed by him personally, making the allegations circulating online inaccurate and misleading.

Balance Between Free Speech and Defamation

In his plea, Gadkari maintained that the legal action is not aimed at preventing legitimate public discussion or constructive criticism of government policies. Instead, the petition argues that the disputed posts go far beyond the limits of lawful free expression by spreading false and defamatory claims without factual support.

The High Court’s observations underline the growing importance of responsible content moderation as artificial intelligence and deepfake technology become more common. The case is expected to contribute to the broader discussion on the responsibility of digital platforms in addressing defamatory and manipulated online content while protecting lawful freedom of expression.
