Licensing –  A devastating fire at a bed-and-breakfast property in Delhi’s Hauz Rani area, which claimed the lives of 23 people, has brought renewed attention to serious gaps in regulatory monitoring. An internal investigation conducted by the Municipal Corporation of Delhi (MCD) has revealed a series of administrative shortcomings, including licence approvals granted despite expired permissions and repeated concerns that allegedly went unaddressed for years.

Inquiry Highlights Licence Renewal Irregularities

According to findings from the MCD Public Health Department, the establishment’s licence renewal process contained several unusual developments. Records indicate that the application for the 2025-26 licence period was filed in April 2025. However, after moving through the required administrative stages, the file reportedly appeared before the concerned official only in January 2026.

The approval was eventually granted on June 2, 2026, just one day before the fatal fire. Investigators noted that the licence itself had already expired on March 31, 2026, meaning the property was operating without a valid active licence during that period.

Fresh Application Submitted on Day of Fire

The inquiry further revealed that the owner of Flourish Stay B&B submitted a new application for the 2026-27 licence renewal on June 3, the same day the fire broke out. Sources familiar with the matter stated that the application was later rejected within hours.

Officials reviewing the case found that a health trade licence had been approved after its validity period had already ended. The report also pointed to several previous approvals that were granted despite apparent compliance concerns associated with the property.

Questions Raised Over Administrative Accountability

The findings have intensified scrutiny of regulatory procedures within the civic body. While the inquiry has identified multiple lapses, questions remain regarding whether any officials responsible for the approvals will face disciplinary action.

Authorities are now examining how the establishment continued operating despite recurring concerns linked to licensing and compliance requirements.

Expansion of Property Under Examination

Investigators have also focused on structural changes made to the property after it was acquired by its current owner in 2022. Sources said the establishment had been functioning for nearly ten years but underwent major expansion in recent years.

Permission from the Delhi Tourism Department had originally been granted for a six-room bed-and-breakfast operation. However, officials believe the property later expanded beyond the approved limit, bringing it under the jurisdiction of municipal regulators.

The role of the MCD Building Department is also being reviewed as part of the investigation. Reports suggest that three additional floors were added after the ownership change, and authorities are now examining whether all necessary permissions had been obtained.

Licence Category Under Scrutiny

Another significant issue identified by investigators relates to the type of licence obtained by the establishment. Records show that the property secured a tea-and-snacks licence in 2023. However, officials suspect that the premises may have been functioning as a full-scale restaurant rather than a limited refreshment outlet.

Despite these concerns, the licence reportedly continued to receive renewals in 2023, 2024, and 2025.

Land Use Compliance Checks Allegedly Overlooked

Sources involved in the inquiry stated that municipal authorities are expected to verify land-use status, permitted commercial activities, and compliance with licence conditions before granting approvals.

The report suggests these assessments may not have been conducted adequately. Investigators also examined whether the actual activities carried out at the property matched the category under which the licence had been issued.

Officials are now reviewing how approvals continued even as the establishment allegedly operated beyond the scope allowed under a tea-and-snacks licence.

Focus Shifts to Possible Action

With the inquiry report now submitted to senior civic authorities, attention is turning toward accountability and enforcement. The findings are expected to play a key role in determining whether disciplinary measures will be initiated against officials found responsible for regulatory failures connected to the property.
