ViolenceCase – NIA Court Grants Default Bail to 15 Accused in Beldanga Unrest

ViolenceCase – A special court under the National Investigation Agency (NIA) on Saturday allowed default bail to 15 individuals arrested in connection with the violence that broke out earlier this year in Beldanga, located in West Bengal’s Murshidabad district. The decision came after the investigating agency did not file a chargesheet within the legally mandated 90-day period following their arrest.

Court Grants Relief Due to Procedural Delay

The court’s order was based on provisions that permit bail when an investigation agency fails to complete its chargesheet within a stipulated time. While granting relief, the court also imposed specific conditions on the accused to ensure compliance with legal requirements during the ongoing probe.

The development marks a significant turn in the case, which has remained under scrutiny due to the scale of unrest and subsequent political attention.

Background of the Beldanga Violence

The unrest in Beldanga erupted after the body of a migrant worker from the region was brought back from neighbouring Jharkhand. His death triggered widespread anger among locals, leading to protests that quickly escalated into a volatile situation.

Residents alleged that the worker had been killed due to religious and linguistic differences. These claims intensified emotions on the ground, prompting demonstrations that included road and railway blockades.

Protests Turn Violent Amid Police Action

Tensions rose sharply when law enforcement agencies attempted to clear the blockades. Protesters reportedly retaliated, leading to clashes with security personnel. In the chaos, several individuals, including journalists covering the situation, were attacked and sustained serious injuries.

The situation in Beldanga remained tense for days, drawing attention from both state authorities and national agencies.

Contradictory Findings on Worker’s Death

Amid growing unrest, Jharkhand Police issued an official statement based on the postmortem findings, indicating that the migrant worker’s death was a case of suicide. This contradicted the claims made by protesters, further complicating the situation and adding to the confusion surrounding the incident.

The conflicting narratives played a role in prolonging tensions and raised concerns about misinformation during sensitive situations.

Political Reactions and Criticism

The incident also sparked political debate. Yusuf Pathan, a Member of Parliament from the ruling Trinamool Congress and a former cricketer, faced criticism for his absence during the crisis. Critics questioned his lack of presence in the constituency at a time when the area was experiencing significant unrest.

The opposition, led by senior leader Suvendu Adhikari, took the matter to the Calcutta High Court, seeking intervention. The petition called for the deployment of Central Armed Police Forces (CAPF) and requested that the investigation be transferred to the NIA.

Legal Proceedings Lead to NIA Involvement

Following court proceedings, the matter eventually reached the Supreme Court. The apex court supported the view that the Union Home Ministry could direct the NIA to take over the investigation if deemed necessary.

Subsequently, the central agency initiated its probe into the incident, taking charge of the investigation from state authorities.

Ongoing Investigation and Legal Process

While 15 accused have now secured default bail, the case remains under investigation. Legal experts note that default bail does not imply innocence but is a procedural safeguard to prevent indefinite detention without formal charges.

Authorities are expected to continue their probe, and further legal developments are likely as the investigation progresses and additional evidence comes to light.
