Judiciary – Supreme Court Restores Congress MLA in Sringeri Election Dispute
Judiciary – The Supreme Court on Monday granted interim relief to Congress leader T D Rajegowda by restoring his position as the MLA from Karnataka’s Sringeri Assembly constituency, while sharply questioning the circumstances surrounding the recount process that had earlier overturned the election result.

The apex court observed that democratic institutions should not be undermined through procedural actions, remarking that “democracy can’t be hijacked like this” during the hearing of the matter connected to the 2023 Karnataka Assembly elections.
Supreme Court Grants Interim Relief
A bench comprising Justices Sanjay Kumar and K Vinod Chandran ordered that all proceedings arising from the Karnataka High Court’s April 6 direction for a recount would remain suspended until further orders. The court also directed authorities to restore Rajegowda’s status as MLA with immediate effect.
The judges clarified that the arrangement would remain temporary until the matter is finally decided. The case has now been scheduled for further hearing on May 21. Notices were also issued to the Karnataka government, the Election Commission and other respondents involved in the dispute.
Recount Had Changed Original Election Outcome
The legal battle began after the Karnataka High Court ordered a recount of votes in the Sringeri Assembly constituency. Following the recount process, BJP leader D N Jeevaraj was declared elected, replacing Rajegowda, who had initially won the seat in the 2023 Assembly polls.
Rajegowda’s original victory margin had been extremely narrow, with the Congress candidate securing the constituency by just 201 votes. The recount later altered the declared result, triggering a major legal challenge before the Supreme Court.
Senior Lawyers Challenge High Court Order
Appearing for Rajegowda, senior advocates Kapil Sibal, Mukul Rohatgi and Devadatt Kamat strongly contested the Karnataka High Court’s decision. The legal team questioned both the basis and the legality of the recount direction issued earlier this year.
During the proceedings, the counsels argued that the recount order had serious implications for the electoral process and democratic representation. They urged the Supreme Court to intervene immediately to prevent further complications until the legality of the High Court ruling is examined in detail.
Court Emphasises Democratic Principles
The Supreme Court’s observations during the hearing reflected concern over maintaining public confidence in electoral systems. By restoring Rajegowda temporarily, the bench indicated that any change in a declared election result must undergo strict judicial scrutiny before becoming final.
Legal experts believe the case may have broader implications for future election disputes involving recounts and post-result challenges. The proceedings are also being closely watched in Karnataka’s political circles because the Sringeri constituency has remained politically sensitive since the Assembly elections.

The interim order has brought temporary relief to the Congress camp, while the BJP is expected to continue defending the recount outcome during the next stage of litigation.
