Supreme Court – Supreme Court Closes Coal Block Case Against Former PM Manmohan Singh

Supreme Court –  The Supreme Court has brought the long-running coal block allocation case involving former Prime Minister Manmohan Singh to an end after accepting the Central Bureau of Investigation’s closure reports. The decision overturns an earlier order that had summoned Singh and other individuals as accused, effectively ending the criminal proceedings in the matter.

Supreme Court Sets Aside Special Court’s Summoning Order

In a significant ruling delivered on Wednesday, the Supreme Court quashed the order of a Special Court that had directed former Prime Minister Manmohan Singh to appear as an accused in connection with the Talabira-II coal block allocation case. The apex court accepted the closure reports submitted by the Central Bureau of Investigation (CBI), concluding that there was no legal basis to continue the criminal proceedings against Singh or the other accused.

The judgment was delivered by a Bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and V. Mohana, who held that the investigation reports filed by the CBI should have been accepted by the trial court.

Bench Finds No Basis to Reject Closure Reports

While delivering its verdict, the Bench observed that although the appeal had technically become infructuous following the passing of Manmohan Singh, it was still necessary to examine whether the Special Judge had acted correctly in taking cognisance of the case after considering the CBI’s closure reports.

According to the court, established legal principles consistently followed in previous Supreme Court rulings make it clear that there must be valid and convincing reasons to reject an investigation report recommending closure. In this case, the Bench found that such reasons were absent, making the Special Court’s decision legally unsustainable.

Appeal Allowed and Proceedings Brought to an End

The Supreme Court allowed the appeal, cancelled the Special Court’s order summoning the accused, and formally accepted both closure reports submitted by the investigating agency. As a result, the criminal proceedings related to the case have now been closed, providing relief to all those named in the matter.

The ruling also grants a clean slate to industrialist Kumar Mangalam Birla, former Coal Secretary P.C. Parakh, and three other individuals who had been named alongside the former Prime Minister.

Background of the Talabira-II Coal Block Case

The case arose from the 2005 allocation of the Talabira-II coal block in Odisha. A Special Court had earlier summoned Manmohan Singh, Kumar Mangalam Birla, P.C. Parakh, and others in connection with the allocation process.

The Supreme Court had previously stayed that order while hearing appeals filed by the accused. During the proceedings, Singh argued that mandatory sanction required for prosecuting a public servant had not been obtained before initiating criminal action against him. He also maintained throughout the legal process that he had committed no criminal offence in relation to the coal block allocation.

With the Supreme Court now accepting the CBI’s findings and setting aside the Special Court’s decision, the legal proceedings in the case have reached their conclusion.
