ElectionLaw – Former South Korean President Yoon Suk Yeol is facing renewed legal pressure after a special counsel team requested a two-year prison sentence over alleged violations of the country’s election laws during the campaign period leading up to the 2022 presidential election.

Sentencing Request Presented in Court

The recommendation was submitted on Monday at the Seoul Central District Court during the final hearing of Yoon’s trial. The case centers on accusations that he breached the Public Officials Election Act while serving as the presidential candidate of the People Power Party (PPP).

Prosecutors from the special counsel team led by Min Joong-ki argued that Yoon made statements during the election campaign that were not truthful and may have influenced public perception ahead of the closely contested vote.

Allegations Linked to Campaign Statements

According to the prosecution, Yoon falsely stated during a televised debate in December 2021 that he had never introduced a lawyer to a former official of the national tax service.

Investigators have also questioned remarks he reportedly made during a media interview in January 2022. In that interview, Yoon allegedly denied having direct connections with Jeon Seong-bae, a controversial shaman figure, and said he had not met him alongside his wife after being introduced through a party official.

The prosecution maintains that these comments were misleading and constituted violations of election regulations designed to ensure transparency and fairness during political campaigns.

Connection to Wider Influence Investigation

Jeon Seong-bae has remained a subject of public attention because of his reported relationship with former first lady Kim Keon Hee. Last month, an appellate court handed Jeon a five-year prison sentence after finding him guilty of accepting bribes connected to the Unification Church in 2022. Court findings indicated that the offenses involved cooperation with Kim, further intensifying scrutiny surrounding individuals linked to the former presidential administration.

Impact on the 2022 Presidential Race

The special counsel team told the court that the alleged false statements were significant because they occurred during a highly competitive election. Yoon secured victory in the 2022 presidential race by a very narrow margin, making the credibility of campaign information a key issue in the case.

Prosecutors contend that voters may have been affected by the disputed remarks, which is why they are seeking a prison term rather than a lighter punishment.

Potential Financial Consequences for the PPP

If Yoon is ultimately convicted and receives a final penalty that includes a fine of at least 1 million won (approximately 651 U.S. dollars), the consequences could extend beyond the former president himself.

Under South Korean election law, such a ruling could require the People Power Party to repay roughly 39.7 billion won that had previously been reimbursed for campaign-related expenses during the 2022 presidential election.

Multiple Legal Cases Continue

The election law case is only one of several legal battles confronting the former president. Yoon is currently involved in multiple court proceedings following his failed attempt to impose martial law in December 2024.

Earlier this year, a Seoul court sentenced him to life imprisonment after finding him guilty of leading an insurrection connected to that unsuccessful effort. The ongoing trials continue to shape one of the most significant political and legal chapters in South Korea’s recent history.
