Employment Rules – The Supreme Court has underlined that recruitment to public sector positions must strictly follow the eligibility criteria laid down for each post, emphasizing that every qualified applicant deserves an equal opportunity to compete within the prescribed framework. The court observed that overlooking such conditions can unfairly disadvantage candidates for whom these positions are specifically intended.

Court Reviews Appointment Made Through Concealed Qualification

The observation came during the hearing of a case involving a temporary bank attendant whose appointment had earlier been restored by the Madras High Court. A bench comprising Justices Ahsanuddin Amanullah and R. Mahadevan overturned that decision after finding that the employee had failed to disclose his graduation degree while applying for a position reserved for candidates with educational qualifications up to Class 10.

According to the court, the individual secured employment in a category that was never intended for graduates. The judges noted that such concealment directly affected the fairness of the recruitment process and undermined the purpose behind the eligibility requirements established for the post.

Higher Qualifications Cannot Override Recruitment Conditions

In its ruling, the apex court stressed that public employment opportunities must remain available to candidates who meet the exact qualifications specified by the recruiting authority. Allowing applicants with qualifications beyond the prescribed limit to occupy such positions, the bench said, could deny opportunities to genuinely eligible individuals who fall within the intended category.

The judges explained that recruitment norms are designed to ensure balanced access to employment and must be respected by both employers and applicants. Any deviation from these standards could disrupt the objective of equitable selection and reduce opportunities for deserving candidates.

Purpose of Qualification Limits Recognised

The court further stated that setting an upper educational qualification for certain posts is neither arbitrary nor unreasonable. Instead, it serves a social and economic purpose by creating employment avenues for individuals who may not have had the opportunity to pursue higher studies because of personal or financial circumstances.

The judgment highlighted that many lower-level positions are intentionally reserved for candidates with limited educational backgrounds. Such policies help ensure that these applicants are not forced to compete against candidates with significantly higher qualifications, who may possess a substantial advantage during the selection process.

State’s Role as a Fair Employer Emphasised

While delivering the verdict, the bench observed that the government and public institutions are expected to act as model employers. Reserving specific categories of jobs for less-qualified candidates is a legitimate policy choice aimed at promoting fairness and broader access to employment.

The court noted that similar recruitment policies have repeatedly received judicial approval over the years because they support social equity and help distribute employment opportunities more effectively across different sections of society.

Bank’s Dismissal Decision Upheld

Concluding the matter, the Supreme Court upheld the bank’s decision to terminate the employee’s services. The judges ruled that the appointment had been obtained by withholding material information regarding educational qualifications, making the dismissal legally justified.

The verdict reinforces the principle that transparency and adherence to recruitment rules are essential components of public employment. It also sends a clear message that eligibility conditions cannot be ignored or bypassed, regardless of an applicant’s higher educational achievements.
