Judiciary – Arvind Kejriwal Seeks Transfer of Delhi Excise Case to New Bench

Judiciary –  Former Delhi Chief Minister Arvind Kejriwal has written to the Chief Justice of the Delhi High Court, Devendra Kumar Upadhyaya, requesting that a case related to the Delhi excise policy be reassigned to a different judicial bench. In his letter sent on Wednesday, Kejriwal argued that transferring the matter would help maintain neutrality and public confidence in the judicial process.

In the communication addressed to the Chief Justice, Kejriwal asked that the criminal revision petition linked to the excise policy case be moved away from the bench currently hearing it. The matter is presently before Justice Swarana Kanta Sharma. According to Kejriwal, the transfer would ensure that the case is reviewed independently and fairly.

The former chief minister stated in the letter that the reassignment is necessary to preserve trust in the justice system and to avoid any perception that the proceedings could be influenced by earlier judicial observations.

Concerns Raised Over Earlier Judicial Observations

Kejriwal’s representation pointed out that the judge handling the matter has already expressed detailed preliminary views on issues related to the case. These observations, he argued, are closely connected to questions being examined in the Central Bureau of Investigation’s revision petition challenging an earlier discharge order.

Because of this overlap, Kejriwal said that having the same bench hear the revision could raise concerns about impartiality. He suggested that the case would be better addressed if assigned to another bench that has not previously commented on the matter.

In the letter, Kejriwal emphasized that the request is not intended to question the integrity of the court but rather to safeguard the perception of fairness in the legal process. He stated that transferring the case would help ensure that all parties receive an unbiased hearing.

He also noted that maintaining public confidence in the judiciary is essential, particularly in cases that have attracted significant public attention and political debate.

Other leaders from the Aam Aadmi Party have also sought a change in the bench handling the case. Former Delhi Deputy Chief Minister Manish Sisodia and Kejriwal, through separate submissions filed by their legal teams in the Delhi High Court, have requested that the proceedings be assigned to what they described as an impartial bench.

Their lawyers argued that such a step would reinforce confidence in the judicial review of the excise policy investigation and ensure that the matter is assessed without prior judicial opinions influencing the outcome.

Background of the Excise Policy Dispute

The case relates to the Delhi government’s excise policy that was introduced in 2021 and later withdrawn amid allegations of irregularities. Investigating agencies, including the Central Bureau of Investigation, have examined the policy framework and the circumstances surrounding its implementation.
