Politics – Nitish Kumar Set to Resign from Bihar Council Today

Politics –  Bihar Chief Minister Nitish Kumar is expected to step down from the Bihar Legislative Council on March 30, following his recent election to the Rajya Sabha. The move comes in accordance with constitutional provisions that prevent individuals from holding positions in both a state legislature and Parliament simultaneously.

Constitutional Requirement Prompts Resignation

Nitish Kumar’s resignation is linked to his election to the Rajya Sabha earlier this month. As per constitutional rules, any member of a state legislature must relinquish their seat within 14 days of being elected to Parliament. A senior leader from the Janata Dal (United) confirmed that Kumar will complete this formality within the stipulated deadline.

The rule, outlined under provisions governing dual membership, ensures that elected representatives maintain a single legislative role at any given time. March 30 marks the final day for compliance in Kumar’s case.

BJP Leader Nitin Nabin Also Expected to Step Down

In a related development, Bharatiya Janata Party leader Nitin Nabin is also likely to resign from the Bihar Legislative Assembly. Although preparations were made for his resignation a day earlier, he reportedly had to travel to Delhi for urgent matters, delaying the process.

Sources indicate that all necessary arrangements have now been completed at the Assembly secretariat for both resignations. Nabin is expected to submit his resignation alongside Kumar, bringing both cases in line with constitutional mandates.

Legal Framework Governing Dual Membership

The resignations fall under the Prohibition of Simultaneous Membership Rules, 1950, which derive authority from Articles 101 and 190 of the Constitution. These provisions apply uniformly to all elected representatives who transition from state legislatures to Parliament.

Failure to comply within the specified timeframe could result in automatic disqualification from one of the positions. This makes timely resignation not just procedural, but legally essential.

Uncertainty Over Chief Ministerial Transition

While Kumar’s resignation from the Legislative Council appears certain, questions remain about his future as Chief Minister. JD(U) national working president Sanjay Kumar Jha recently stated that while Kumar would step down from the Council within the deadline, there is no confirmed timeline regarding his position as Chief Minister.

This uncertainty has fueled speculation about potential political changes in Bihar. Discussions around leadership transition have intensified, especially within the BJP, which is part of the ruling alliance.

BJP Internal Discussions Gain Momentum

Political activity has picked up pace in recent days, with reports suggesting that the BJP may be considering appointing its own Chief Minister. If this happens, it would mark a significant shift in the state’s political landscape.

Party insiders have indicated that a leader with roots in the Rashtriya Swayamsevak Sangh could be a potential candidate. Although no official announcement has been made, internal consultations are reportedly ongoing.

Background of Political Developments

The possibility of replacing Nitish Kumar is not new. Following the 2020 Bihar Assembly elections, the BJP had explored similar options but was unable to move forward due to political constraints at the time.

After the 2025 Assembly elections, the National Democratic Alliance secured a decisive victory, allowing Kumar to take oath as Chief Minister for the tenth time. However, recent developments suggest that his tenure could be shorter than expected.

Assembly Speaker’s Visit Adds to Speculation

Adding to the unfolding political situation, Bihar Assembly Speaker Prem Kumar recently traveled to Delhi for an official कार्यक्रम but returned to Patna the same day. He was informed that Nitin Nabin intended to submit his resignation, prompting his early return.

However, Nabin did not complete the process that day due to unforeseen circumstances, leading to further delays and speculation around the timing of key political decisions.

As Bihar awaits these formal resignations, attention now turns to possible shifts in leadership and the broader implications for governance in the state.
