LegalStay – Delhi High Court Pauses Proceedings in Protest Case
LegalStay – The Delhi High Court on Monday ordered a temporary halt to proceedings in a case linked to a political protest involving several prominent opposition leaders, including Rahul Gandhi, KC Venugopal, Akhilesh Yadav, and leaders from the DMK. The matter stems from a demonstration held earlier this year in the national capital.

Court Intervenes in Ongoing Legal Process
The case relates to a protest organized at Jantar Mantar on February 6, 2025, reportedly conducted without prior official permission. The gathering was held to oppose draft guidelines issued by the University Grants Commission (UGC). A chargesheet had already been submitted before a trial court, though the court had not yet taken formal cognisance of the matter.
Justice Anup Jairam Bhambhani, while hearing the petition, directed that further proceedings in the case be put on hold. The court also issued a notice to the prosecution, seeking a detailed status report within six weeks. The matter has been scheduled for its next hearing on August 12.
Legal Grounds and Observations
In his order, Justice Bhambhani observed that, at a preliminary level, the arguments presented and judicial precedents cited warranted a pause in the case. He specifically referred to provisions under Section 215 (1)(a)(i) of the Bharatiya Nagarik Suraksha Sanhita while granting the stay.
The court’s directive ensures that no further investigation or legal action related to the FIR will proceed until the next hearing date. This interim relief provides temporary respite to the individuals named in the case while allowing the court to examine procedural aspects more closely.
Questions Over Investigation Procedure
Earlier, the High Court had raised concerns regarding the manner in which the investigation was conducted. It had sought clarification from the Delhi Police over alleged procedural lapses, particularly the filing of a chargesheet against 11 individuals while reportedly not issuing notices to 10 of them to participate in the investigation.
These concerns appear to have influenced the court’s decision to pause the proceedings, as it reviews whether due legal process was followed during the investigation stage.
Separate Development Involving Gautam Gambhir
In a separate matter before the same court, India’s head cricket coach Gautam Gambhir withdrew a plea related to the alleged misuse of his personality rights. The petition had sought an interim injunction against the circulation of deepfake content using his identity.
According to his legal counsel, the application will be refiled with more comprehensive details. The plea had highlighted concerns over fabricated videos, including one falsely depicting Gambhir announcing his resignation.
Broader Implications
The High Court’s intervention in the protest-related case underscores the importance of adherence to due process in criminal investigations, especially in matters involving public figures. By seeking further clarification and halting proceedings temporarily, the court has signaled the need for careful scrutiny of procedural compliance.
At the same time, the separate case involving alleged deepfake content reflects growing legal challenges linked to digital manipulation and identity misuse, an issue gaining increasing attention in courts across the country.
As both matters proceed, the outcomes could have implications not only for those directly involved but also for broader legal standards concerning protests, investigations, and digital rights.
