AccidentCompensation – A Motor Accident Claims Tribunal in Delhi has directed payment of Rs 1.52 crore as compensation to a man who was left completely disabled after a road accident in 2022. The decision comes after a detailed examination of evidence, with the tribunal concluding that the incident occurred due to negligent driving.

Tribunal Holds Driver Responsible for Negligence

The case was heard by Presiding Officer Sudeep Raj Saini, following a petition filed by Bharat Ghai, who suffered critical injuries in the accident that took place on February 11, 2022. According to the tribunal’s findings, a speeding car hit the petitioner, resulting in severe head trauma.

In its order dated March 16, the tribunal observed that the evidence presented clearly indicated rash and careless driving by the vehicle’s owner, identified as the primary respondent. The conclusion was reached based on the standard of probability commonly applied in such civil matters.

Severe Injuries Leave Victim Bedridden

Medical documents presented during the proceedings confirmed that the accident caused significant brain damage. As a result, the petitioner has been rendered completely immobile and unable to carry out even basic daily activities independently.

The tribunal noted that the extent of injury had effectively confined the victim to a bedridden condition. Doctors assessed the disability as total in functional terms, meaning the individual is unable to engage in any form of employment or self-care.

Lifelong Dependence on Assistance Recognised

While determining the compensation amount, the tribunal also took into account the long-term care requirements of the petitioner. It acknowledged that the injured man would need constant support for everyday tasks, as well as ongoing medical supervision.

The order highlighted that at least one full-time attendant would be necessary throughout his life. This factor significantly influenced the final compensation figure, which was calculated to cover both medical needs and personal assistance over an extended period.

Defence Argument Rejected by Tribunal

The legal representatives of the vehicle owner argued that the car in question was not involved in the accident. However, the tribunal dismissed this claim after reviewing multiple pieces of evidence.
