BiharElections –The Jan Suraaj Party, led by former political strategist Prashant Kishor, has approached the Supreme Court questioning the validity of the 2025 Bihar Assembly elections and demanding a fresh mandate in the state. The plea alleges that certain actions taken by the state administration during the election period compromised fairness and violated established electoral norms. The case is expected to be listed for hearing later this week before a bench headed by Chief Justice of India Surya Kant along with Justice Joymalya Bagchi.

Disputed Poll Outcome and Political Performance

The recent assembly elections concluded with the Bharatiya Janata Party-led National Democratic Alliance (NDA) securing a decisive majority. The ruling alliance won 202 seats out of the 243-member assembly, comfortably retaining control of the state government. In contrast, the opposition coalition, known as the INDIA bloc, managed to secure only 35 seats, including six victories attributed to the Congress party.

The Jan Suraaj Party, contesting its first major electoral test under Kishor’s leadership, did not manage to win a single seat. Several of its candidates also failed to meet the minimum vote threshold required to retain their election deposits, indicating limited electoral traction across constituencies.

Allegations Regarding Government Financial Scheme

In its petition, the Jan Suraaj Party has accused the Bihar government of breaching the Model Code of Conduct. The party claims that a financial assistance scheme targeting women voters was implemented after the official announcement of the election schedule. According to the petition, the government allegedly transferred Rs 10,000 directly into the bank accounts of women beneficiaries under the Mukhyamantri Mahila Rojgar Yojana during the restricted campaign period.

The party has argued that such financial transfers could have influenced voter behaviour, thereby affecting the fairness of the electoral process. It has urged the Supreme Court to examine whether these actions amounted to inducement and violated election guidelines meant to ensure a level playing field among contesting parties.

Legal Provisions Cited in the Petition

The petition seeks intervention from the Election Commission of India under Article 324 of the Constitution, which grants the poll panel authority to supervise and conduct elections across the country. Additionally, the party has cited Section 123 of the Representation of the People Act, which defines corrupt practices, including offering monetary benefits to influence voters.

The Jan Suraaj Party has requested the court to direct authorities to investigate the alleged transfers and determine whether they affected the credibility of the electoral outcome. The petition also seeks directions for corrective measures if the court finds any violation of electoral regulations.

Purpose of the Welfare Initiative Under Scrutiny

The Mukhyamantri Mahila Rojgar Yojana is designed as a welfare initiative aimed at promoting financial independence among women. The scheme provides an initial grant of Rs 10,000 to support women interested in starting small businesses or self-employment ventures. The program is intended to enhance economic participation and improve livelihood opportunities for women across Bihar.

Government representatives have maintained that the scheme is part of ongoing welfare measures and is not linked to electoral considerations. However, the timing of fund distribution remains a central issue in the ongoing legal dispute.

Legal experts note that the Supreme Court’s response to the petition could have wider implications for election-related welfare schemes across India. If the court decides to conduct a detailed review, it may establish clearer guidelines regarding the implementation of financial assistance programs during election periods.
