ElectionDispute –  The Madras High Court on Tuesday chose not to lift its earlier interim order that had paused proceedings in a city civil court case involving a dispute within the Pattali Makkal Katchi (PMK) leadership. The case, filed by party founder S Ramadoss against his son Anbumani Ramadoss, concerns the use of the party’s name, flag, and election symbol.

Court Links Case Timeline With Election Process

Justice T V Thamilselvi observed that the ongoing Assembly election process should not be disrupted by parallel legal proceedings. Taking this into account, the court directed that the civil court should resume hearing the case and related interim applications only after May 10, by which time the election process is expected to conclude.

The judge’s order effectively ensures that the dispute does not interfere with electoral activities, maintaining a clear separation between the legal process and the conduct of elections.

Petition Filed by Anbumani Faction Representative

The matter reached the High Court following petitions submitted by Vadivel Ravanan, who serves as the general secretary of the faction led by Anbumani Ramadoss. In his plea, Ravanan requested that the civil court be instructed to first decide on his impleadment petition before proceeding with the main civil suit filed by S Ramadoss.

An impleadment petition typically seeks to include a party in an ongoing case, allowing them to present their position before any final decision is made. Ravanan argued that his inclusion was necessary before the court could properly consider the merits of the case.

Interim Stay Continues on Civil Court Proceedings

After reviewing the submissions, the High Court had earlier granted an interim stay on the civil court proceedings. This meant that the lower court was temporarily barred from taking further action in the matter.

Subsequently, S Ramadoss approached the High Court with a request to vacate this stay, seeking to allow the civil court to proceed without delay. However, the High Court declined this request, maintaining its earlier position.

Election Process Cited as Key Consideration

During the hearing, counsel representing Anbumani Ramadoss pointed out that the nomination process for the Assembly elections in Puducherry had already commenced. He argued that once the election process begins, judicial intervention in related matters should be avoided.

The court appeared to accept this reasoning, noting that the conduct of elections is governed by a structured legal framework that limits interference during active electoral phases. This principle has been upheld in several cases to ensure that elections proceed smoothly without external disruptions.

Legal and Political Implications

The dispute between S Ramadoss and Anbumani Ramadoss has drawn attention due to its potential impact on the functioning of the PMK, particularly during an election period. Control over party identity elements such as the name, flag, and symbol is critical, as these are directly linked to voter recognition and ballot representation.

With the High Court’s directive in place, the civil court is expected to resume hearings after May 10. At that stage, it will consider both the main suit and the pending interim applications, including the impleadment request.
